-2- Question How can you justify good planning practices (with respect to separating industrial and residential areas) by permitting 9 single family homes to be built with a 22 foot high concrete wall at the end of their back yard? Our: second major concern regards Council's policy with respect to creating transitian zones between industrial and resi- dential developments. Pledse consult a copy of the "Mary Hill Industrial Plan Report™ of September, 1985, Pages 9 and 10. This section of the Report dé@als with the Kingsway=McLean industrial area. On Page 10 the City has outlined a number of policies for development in the area. The very first policy states "Buffering the surrounding residential neighbourhoods from industry by re« quiring a 20-meter setback along the side of industrial properties beside residences.” This policy was enforced when we built our building as we were required tc aave 20 meters between our rear lot line and the rear of our bi ding. Therefore, for Council to consider allowing this proposal, it would be only appropriate to also enforce this policy between our building and the proposed residential properties. With this required residential rear yard and front yard setbacks also taken into account, less than 8 meters is left to build upon - therefore making it impossible to develop this site for housing without relaxing the 20 meter buffer strip requirement. Question 2. Is Council prepared to go against its own policy as outlined in the Mary Hill Industrial Plan Report (Page 10) with respect to creating a buffer strip between residential and -ndust:tial areas? | Please realize that should Council not follow its own policies with respect to the buffer strip, owners of buildings that have left the required buffer strip may wish to have the policy relaxed on their sites as well so that they can make additions to their existing warehouses. A third concern which we have regards the proposal to allow access to the proposed residential lots. Assuming that the answer to Question 2 is "yes" and Council decides to forget about requiring a’ buffer strip betwen the two lots, some attention must be given to ensuring that the provisions of the existing zoning by~Law are adhered to. Section 1003 (3)(£) states that the minimum side yard flanking a lane must be 6 meters. Therefore, the propo- sal must show the lane as being at least 6 meters from our property line. The City is not permitted to allow our property to become non-conforming. Question 3. Is the proposed lane separated from our property ' line by at least 6 meters? What will become of the 6 meter strip? Will it belong to all nine owners? Will it be dedicated as park? Who will maintain it? ITEM } PAGE
