COUNC MENORANDUM DE 13 1976 Mayor and Council December 9th, 1976 ° Leisure Activities Committee Re: Use of City-land for School Site — Oxbow Development Council may recall that last year a request was received from the District of Coquitlam asking that the City consider making available, for a school site, a portion of the Crown Grant land owned by the City lying north of our cemetery site. A copy of a map is attached showing the location of this land. The matter was discussed briefly by the Planning and Zoning Committee and the Land Sales Committee last.year. The Planning and Zoning Committee commented that from a Planning point of view, the use of the property as a school site appeared to be acceptable as the land was of little use to the City. The Land Sales Committee did not wish to deal with the question of disposing of this property until such time as an official letter was received from the School Board indicating that they were, in fact, interested in the site. The Oxbow Development appears to be in progress once again and we have now received a letter from the School Board indicating that they are prepared to accept the site for school purposes and have asked that the City take the necessary steps to transfer title. This matter was discussed tecently at a meeting of the Leisure Activities Committee ag the land was conveyed to the City under a Dominion Crown Grant to be used exclusively for park purposes. The Committee has determined the following: . 1, Enquiries through the Department of Environment in Victoria indicate that the Province can make provision for transferring title of the park area to the School Board. ’ 2. The City must relinquish title to the 6 acres and the Department advised that they will not give the School Board title, but would only lease the site to the Board on a long-term basis. Before this is done, they would require written confirmation from both the Board and the Department of Education that the land is acceptable and required for a school site. 3. Once the City relinquish title, we have no further claim to the property, however, in view of the fact that the Department would only lease to the Board, we might be able to get them to agree to a stipulation where’y if the lease was ever terminated, the City could regain title to the property under the original terms of the Crown Grant.
