Hydro hereby offers to consent to the proposed Coquitlam-River Dyking on the right bank frem Kingsway Bridge to Maple Creek (hereinafter referred to as the "encroachment" ) as shown on Ministry of Environment Drawings for Project No. 10, Contract No. 4, Sheets 3,4 and 6 dated April 1990 in consideration of the Corporation of the City of Port Coquitlam (hereinafter referred to as the "Corporation") agreeing to the following conditions: l. The Corporation shall not hold B.C. Hydro responsible for any damage to the encroachment or for anything that would interfere with or hinder the efficient operation or performance of the encroachment arising out of B.C. Hydro's activities within the right of way, (unless caused solely by the negligence of B.C. Hydro, its servants or agents.) Except as provided in paragraph 1 above, the Corporation shal] assume any and all risks arising out of or connected with the encroachment within the right of way and will indemnify and save .
