10. The Grantor and Grantee covenant, promise and agree as
a Covenant granted to the City under Ssction 215 of tne Land
Title Act, that the Easement Area shall be used [In accordance
with this Agreement and that the Easement provided for herein
shall not be removed, released, amended or discharged without the
express written permission and consent of the City.

11. Whenever the singular or mascu! ine Is used In this
Agreement, the same ls deemea ta Include the optiural or the
feminine or the body politic as the context so requires; every
reference to each party Is deemed toa Include the heirs,
executors, administrators, successors, assigns, emp loyees,
servants, gents, tenants, customers, licencees, contractors and
Invitees of such party.

12. This Agreement = shail enure to the benefit of and be
binding upon the parties hereto notwithstanding any ruie of law
or equity to the contrary.
