DISCUSSION: The subject property's dimensions are 66 feet x 122 feet. The applicants are seeking approval for rezoning in order to subdivide the property into two 33—foot lots. These new lots would not conform to the Zoning Bylaw, which requires that RS-2 lots have a minimum lot width of 40 feet. The area of each lot would also be slightly less than the RS-2 minimum lot area requirement. The Zoning Bylaw provisions would have to be amended in order to permit lots of a smaller size. (Council can not relax the minimum area of a lot by any . other means.) Furthermore, the subject property is within an area that is designated "Apartment" in the 0.C.P. Rezoning to RS-2 would encourage the development of new single-family residences, which is contrary to the 0.C.P. As the property cannot be subdivided into two conforming lots and the proposed use is contrary to the intended uses specified in the 0.C.P., it recommended that this application not be approved. n ~1DS74-7/8
