Your letter of the 2nd September last has been referred to me by the Land Com- missioner. J have had tracing attached to each one of the enclosed conveyances, and enclose herewith an extra blue print. for your copy of conveyance which you desire to keep, I note that you” request that a conveyance be incorporated in this Deed, that a siding be placed and maintained on this land, The Company would much prefer to have clear title to this right-of-way, but at the same time it is their intention to establishand maintain a siding on this property, and it seems to ime that an undertaking in the form of a letter would be sufficient for-your purposes, Iam, therefore, authorized to undertake, an behalf of the Grand Trunk Pacific Railway Co., that the Company will construct a siding upon the land described in the enclosed conveyance, and that so long as the Company’s line of railway is in its present location, this siding will not be removed east or west of this land. “You will understand that the lecation of the Company’s line ’ might be at some future time and for some unforeseen cause changed by the Board of Railway Commission and the Company would nol like to bind itself to maintain a siding at-this point for- ever, as upon the application to the Board the Company might he ordered to change its location. ‘I think the above undertaking should be sufficient guarantee to you of the good faith of the Company and I trust that you will not insist upon this covenant being incorporated in the Deed. “Yours truly. (Signed) CHAS, H.
