The Company agrees that for any work or service which is the subject of this Agreement, it is the Principal Contractor for the purposes of the Workers’ Compensation Board Industrial Health and Safety Regulations for the Province of British Columbia. The Company shall have a safety program acceptable to the Workers’ Compensation Board and shall ensure that all Workers’ Compensation Board safety rules and regulations are observed during the performance of this Agreement, not only by the Company but by all subcontractors workers, materialmen and others engaged in any -‘ork or servic. which is the subject of this Agreement. Prior to commencement of any work or service which is the subject of this Agreement, the Company shall complete and file a “Construction Notice of Project" with the Workers’ Compensation Board and shall provide a capy of the same to the Municipality confirming that the Company shall be. the Principal Contractor responsible for coordination of safety and health under Regulation 4.02 and 34.16(2) of the Workers’ Compensation Board Industrial Health and Safety Regulations. 22. | The Company shall maintain insurance 1n sufficient amount and description as will protect the Company and the Municipality from claims under the Workers Compensation Act and from any other ‘claims for damages, personal injury including death, and for claims from property damage which may arise from the Company's operations in the Municipality under this Agreement, including the use or maintenance of the Equipment on or in the Service Corridors or any act or omission of the Company’s agents or employees while engaged in the work of placing, maintaining, renewing or removing the» Equipment and such coverage shall include all costs, charges and — expenses reasonably incurred with any injury or damage.
