JUN j { 1984 JUN 25 1984 WHEREAS the Railway Act being Chapter R-2 cf the Revised Statutes of Canada, 1970, as amended, Section 248, provides as toliows: "248 (1) When any train is approaching a highway crossing et rail Jevel the engine whistle shail be sounded at lest eighty rods before reaching such crossing and the bel! shall be rung continuously from the time of the sounding of the whistie until.the engine has crossed such highway. Where a bylaw of an urban municipallty prohibits such sounding of the whistle or ringing of the bell in respect of any such crossing or crossings within the limits of the municipality, the bylaw shall, if approved by an order of the Commission, to the extent of the prohibition retieve the company and its employees from the duty imposed by this section. In subsection (2) the expression "urban municipality" means (a) a City; (b) a Town; or . (c) any other municipality that contains a thickly populated area and that the Commission, on the application of such municipality, declares to be an urban municipality within the meaning of that subsection." AND WHEREAS the whistiing of the locomotives on the Canadian Pacific Railway track, whilst traversing the City of Port Coquitiam, disturbs the peace and quiet of the residents of the City of Port Coquitlam, both by day and at night, in the neighbourhood of the at-grade highway rallway crossing on Westwood Street, in the City of Port Coquitlam; ’ AND WHEREAS the necessary protection devices as required by the Canadian Transport Commission have been erected on both sides of the level highway railway ‘crossing on Westwood Street; NOW THEREFORE the Municipal! Counci! of the The Corporation of the City of Port Coquittam, in open meeting assembled, enacts as follows: The sounding of any train engine whistle in accordance with the provisions of Section 248(1) of the Railway Act of Canada, 1970, as amended, in respect of the at-grade highway raliway crossing on Westwood Street at Canadian Pacific Ral lway Crossing mileage 112.8 Cascade Subdivision, within the limits of the City of Port Coquitlam, is hereby prohibited. This Bylaw may be cited for all purposes as the "Sounding of Train Whistles Prohibition (Wastwood Street)Bylaw, 1984, No, 2045", This Bylaw shall come into force on the day upon which It is approved by the Railway Transport Committee of the Canadian Transport Commission.
