SUBJECT: © Purchase of Parkland - Apel Drive at Lynwood RECOMMENDATION: THAT Council give consideration to passage of the following resolution: “THAT Lot 449, South West 1/4, Section 7, Township 40, Plan 62790, New Westminster District be purchased from Cressey Development Corporation for the sum of $1.00; THAT the possession and adjustment date be January lst, 1982; AND THAT His Worship the Mayor and City Clerk be authorized to execute the necessary documents therefore and to affix the Corporate seal thereto." BACKGROUND AND COMMENTS: The location of the above noted property is shown on the map attached to this memorandum and it is a fairly large area of parkland that should have been transferred to the City by Cressey Development Corporation when their subdivision plan of the property on the northside of Lynwood was deposited in the Land Title office last year. Unfortunately, this was. overlooked and it resulted in the parkland lot remaining in the name of Cressey Development Corporation with the result that taxes were assessed against the property last year. Insofar as the City taxes are concerned this has no practical effect but because of this error by Cressey the amount of / $866.18 is actually payable to other taxing agencies, such as the School Board. This matter has been under discussion with the principals of Cressey Development Corporation since June of this year and that firm is quite unwilling to accept any responsibility for the payment of any amount whatsoever, although they are prepared to convey the property to the City for the nominal $1.00. We are recommending that January lst be set as the adjustment date for this purchase as that then makes the City responsible for payment of taxes and although we do not really think the $866.18 amount should really be for the account of the City we nevertheless feel that it is worthwhile to pay this amount to insure that the property does come under City ownership. It is regrettable that this transfer did not take place last year. Wow City Clerk.
