Freeman, City Clerk Leputy Administrator 2525 Shaughnessy Street ~- Chevron Service Station | Development Permit Application 38/91 RESOLUTIONS: (1) That the resolution authorizing the issuance of Development Permit « Application 38/91 for 2525 Shaughnessy Street ~ Chevron Service Statien as given by this Council on October 28th, 1991 be reaffirmed. OR (2) That the resolution authorizing the issuance of Development Permit Application 38/91 for 2525 Shaughnessy Street ~ Chevron Service Station as given by this Council on October 28th, 1991 be rejected and therefore repealed and of no force oF effect whatever. BACKGROUND AND COMMENTS: Pursuant to Section 240 of the Municipal Act Mayor Traboulay has instructed that the resolution authorizing the issuance of Development Permit Application 38/91 for 2525 Shaughnessy Street - Chevron Service Station as given by the Council on October 28th, 1991 he returned to the Council for reconsideration. A copy of the original report to Council follows. Mayor Traboulay is taking this action as he believes the subject resolution was passed without full consideration having been given by Council to all the implications of the resolution. ce Additionally, Mayor Traboulay is of the opinion that Council ‘members were not aware of Section 6 of the City's Business Licence Bylaw which provides: “Eyery person carrying on the business of gasoline or other fuel service stations shall dispense such fuel either himself or by his agent, servant or employee, but not otherwise.” This matter can be dealt with by the Council by passage of either of the resolutions shown above; but not, of course, both.
