any time during the term thereof, the building or structure on the said lands and for which such off-street parking has been provided, is destroyed or is removed from the said lands and is not replaced with another building or structure having the same off-street parking requirements, within a period of one (1) year from the date of such destruction or removal. (ad) This right to park shali not be construed to convey or vest any property or rights in such parking spaces or real property or in the Parking Facility, in the owner or his successor in titie to the said lands, nor shall the Owner be entitled to any allocation of specific parking spaces or to any marking thereof indicating that such spaces have been authorized for his use. All obligations of the City under this agreement shall be Limited to the provision of the number of off-street parking spaces within the Parking Facility for which this right is granted. 2. The Owner agrees with the City to accept this right subject to the terms and conditions of Section 1 hereof, and to be bound by the same. 3. The Owner agrees with the City that if at any time the Municipal Council may deem it expedient to recover any costs incurred by the City in the operation, maintenance and management of the off-street parking facilities provided pursuant to any Bylaw then in force, the City shall have the unrestricted right and liberty to close to the free use by the public the Parking Facility and the parking spaces therein, and to fix and to charge fees or rents for the use of any parking space in such Parking Facility, and pending such action by the City, the Owner shall pay the City for each of the 6 parking spaces the sum of $7.50 commencing the first day of the month following execution of this agreement and on the first day of each and every month thereafter for a total payment to the City each month of $45. _ ITEM | PAGE 22
