That this application be approved to proceed for rezoning from RS-3 (Estate Residential) to RS-2 (Small Lot Residential) under Section 963 of the Municipal Act subject to: Completion of a subdivision design to the satisfaction of the Director of Planning; Satisfaction of Engineering Department requirements}; Satisfaction of Building Department requirements at the time of Building Permit. The project being subject to the 1993 rates for Development Cost Charges; Satisfaction of the Parks and Recreation concerns regarding protection of existing trees; Registration of a restrictive covenant on the properties to prevent new buildings from being converted to contain secondary suitesjand Registration of a No Build Restrictive Covenant for portions of Lots 1 and 2 which will be used for future subdivision in conjunction with property to the south. BACKGROUND: Approval of this application will permit subdivision of the sub ject property into 3 lots at this time. Lots l & 2 (see attached drawing No.1) will be used for single family residences immediately. Portions of these lots will be subject to a ‘No Build" covenant.
