The required elevation shall be achieved by elevation of the Said habitation, business, or Storage area on adequately compacted landfill up to a minimum elevation of four point nine (4.9) metres Geodetic Survey of Canada Datum at the southwest corner of the property on a uniformly increasing gradient to five point five (5.5) metres Geodetic Survey of Canada Datum at the northeast corner of the property. Structural elevation, or a combination of structural and landfill, shall be utilized to achieve the required elevation above above the minimum landfill elevation as defined above. No area below the required underside of floor system elevation shall be developed, finished, or used for the installation of furnaces or Other fixed equipment Susceptible to damage by floodwater. Where landfill is used to raise the natural ground elevation, the face of the landfill slope shall be adequately protected against erosion from flood flows. The area of any building to be utilized for undercover parking of motor vehicles shall be exempt from elevation and landfilling requirements provided they are left undeveloped and unfinished. The owner acknowledges that the Province of British Columbia does not represent to the owner or any other person that the building constructed or mobile home located in accordance with paragraph (1) herein will not be damaged by flooding or erosion, and the owner covenants and agrees not to claim damages from the Province or the Corporation of the City of “Port Coquitlam or hold the Province or the Corporation of- the City of Port Coquitlam responsible for damages caused by flooding or erosion to the land or to any building, improvement, or other structure built, constructed or placed upon the said lands and to any contents thereof. All the parties hereto covenant § and agree that the restrictions and covenants herein contained shall be covenants running with the land and shall be perpetual. 35
