Eng., FILE: S# 25/91 Deputy City Engineer SUBJECT: RAFIKI ESTATES LTD. - 28 LOT SUBDIVISION OF PCL ’A’ DEVELOPMENT COST CHARGE TRUST AGREEMENT AND SECTION 215 BUILDING COVENANT (Pablic Works Committee of March 16, 1993) RECOMMENDATION: That Council approve the execution of the Trust Agreement for pre-payment of Development Cost Charges and Section 215 Covenant stipulating that no building permit will be issued until all off-site services are completed to the satisfaction of the City Engineer. As part of Rafiki Estates Ltd. proposed subdivision of 2478/92 Coast Meridian Road, the developer is required to enter into a Trust Agreement for Development Cost Charges and a Section 215 Building Covenant. The legal description of the parcels are: e Parcel "A" (Ref. Plan 13490), Lot 1, Section 6, Block 6 North Range 1 East, NWD, Plan 8560. Lot 2 Except: North 90 fee, Section 6, Block 6, North Range | East, NWD, Plan 8560. The Trust Agreement is a standard form prepared by the City’s Solicitor. The amount of the Contributions for this development is $275,940.00 which includes payment for highways, water mains, sanitary sewers and drainage facilities. The Section 215 Covenant provides that the owner shall not build, place or erect or permit the building, placement or erection of any building or structure on The Lands and shall not make application for a building permit and no building permit shall be issued in respect of the Lands uniess and until all off-site services necessary for the development of The Lands have been completed to the satisfaction of the City Engineer.
