SUBJECT: 2450 LOBB AVENUE - QKLF GROUP - DYKE RIGHT OF WAY
(Public Works Committee Meeting of June 1, 1993)

RECOMMENDATION:

l. That City Council approve the offer from Quanta Enterprises Ltd. - QKLF Group
to provide financial consideration in the amount of $24,555.56 for five (5) meters
of Right of Way presently dedicated for dyke purpose;

2. That agreements and survey plans required to amend the existing registered Right
of Way be approved; and

3. That additional Right of Way agreements required for drainage and, access and
future servicing be approved.

BACKGROUND & COMMENTS:

Tae development ai 2450 Lobb Avenue is a proposed three phase strata project. As part of
Phase III the proposed building units would abut an existing Dyke Right of Way. The
developers have proposed that they purchase a five meter strip presently designated dyke Right
of Way. The offer is in the amount of $24,555.56 being 5/36 of the original purchase price of
$176,800.00 for this area. Attached are copies of the offer from Quanta Enterprises and a sketch
showing this area.

Ir. \iscussions with the Ministry of Environment who are responsible for the dyking program

they have indicated that because of the property filling this 5 meter area is not required for dyke
purposes. Attached is a letter outlining this issue.

Following consideration, the Public Works Committee recu.nmended that the offer be accepted

and that all necessary agreements and plans to carry out the discharge and registration of a new
Right of Way Agreement be approved.

In addition, the developer is required to provide a further Right of Way for drainage purposes.

Also as part of the proposed phasing of the project an access and service Right of Way is
required. It is recommended that these Right of Ways be approved.
