Freeman, City Clerk RE: Zoning Amendment By-law No. 1273 On the Council agenda of Monday, October 1, 1973, immediately following this memorandum, there appears Zoning Amendment By-Law No. 1273 relating to property owned by the Mary Hill Baptist Church and the Council will note that a portion of the property is being rezoned from P~2 to RS~2 and a portion is being rezoned £rom RS-2 to P-2, We regret to have to advise the Council that By-law No. 1273 is being presented to the Council for consideration to repair an incorrect zone designation applied by Zoning By—law No. 1066, which, as some members of the Council will recall, rezoned a one acre portion of the Mary Hill Baptist Church property on Nova Scotia Avenue to P-2 (Special Institutional) to permit the construction of a church. Unfortunately, the church was not actually built on the one acre portion rezoned and as a result the church is now situated on land that is zoned RS-2, The church has recently applied for a building permit to construct a single family dwelling just east of the existing church and it is this portion which is presently zoned P~2 and the construction of a xesidence in the P-2 zone is not permitted. By-law No. 1273, if finally passed and adopted by the Council, will rezone a site around the existing church to P-2 and will return the incorrect P-2 zone designation to RS-2 in order that construction of the single family dwelling may proceed.
