THE CORPORATION OF THY CLTY OF PORT COQUITLAM BY-LAW NO. 1637 : A By-lav to authorize the City to enter into Land Use Contract No. 39. WHEREAS the "City of Port Coquitlam Zoning By-law, 1969, No. 918" as azended designates certain areas of land within the zones set out “therein as “Developnent Areas"; AND _WHERESS the iands hereinafter described are situate within an area so designated: . , , , ; AND KREREAS the Ouner of the said lands has made application for a Land Use Contract to authorize works, developuent, and use some aspects of which are not in conforalty with the relevant City By-laws as the Sane apply to the zone in which the said lands are situate; AND WHEREAS the Council has given due regard to the following * considerations: 1. (a) the pronotioa of-health, safety, convenience and welfare of the public. , (6) the prevention of the overcrowding of land, and the preservation of the anenities particular to any zone. «) the securing of adequate light, air and access. . (4) the value of the land and the nature of its present and: prospective use and occupancy. ; {e) the character of each zone, the character of the buildings already erected snd the peculfar suitability of the zone for particular use. Cf) the conservation of property values. 2. (a) the development of areas to promote greater efficiency and quality. . . (b) the inpact of development on present and future public costs, (c) the betterment of the environment. (3) the folfilinent of community goals. {e) the provision of necessary public space. and it is deemed desirable’to enter into Land Use Contract No. 30 in the form and to the extent hereinafzer provided; NOW THEREFORE the Municipal Council of The Corporation of che City of Port Coquictan, in open meeting assembled, enacts as follows: 7. The Council of The Corporarion of the City of Port Coquitlam is hereby authorized and empowered to enter into a Land Use Contract with Walter Cordoa Mitt and Clara Laverne Mitt, 2129 Rindall Avenue, Port Coquitlan, B.C, October, 1978. dn .he form and to the extent set forth in “Land Use Contracr No. 30" which is the Schedule hezeto d and made part of this By-lav. . 2. .The said Land Use Contract No. 30 shall extend to and shall regulate ‘the development and use of the lands described therein. J+ Land Use Contract No. 30 shall have the’ force and effect of a restrictive covenant running with the land described therein and shall be registered in the New Westminster Land Registry Office. 4.
