RECOMMENDATION:

That the Mayor and Clerk be authorized to endorse a restrictive os
covenant for Lot 1, D.L. 379 and 464, Goup 1 NWLD Plan 77807. This
restrictive covenant is to provide architectural control over the

shopping centre to be developed on the property formerly known as the
Marathon Site.

COMMENTS:

Part of the City Council approval of rezoning the Marathen
restrictive covenant registered on the property to regulate architecture of
7 its development. The owner's of the Property are nearing completion of their

leasing programme and are preparing for a fourth reading of their rezoning

bylaw. One of the requirements for that fourth reading is this restrictive
covenant.
