Development Variance Permit Application, File No. 35/89

THAT the Clerk's Office be directed to notify surrounding property ownera
of the application and to place the item on a subsequent agenda of Council.

AND THAT Council adopt a resolution at the second meeting to issue a
Development Variance Permit to Lot B, Block 3, D.L. 379, NWLD Plan 1213 to
amend Land Use Contract No.3, Bylaw No. 1201.

ANT THAT Council authorize the Mayor and Clerk to endorse an Encroachment
Agreement to permit the development to have a canopy extend over the
Sidewalk in front of the Property.

This application is to remove the Sign Band from Shaughnessy Mall and to
replace it with a canopy. As the property is governed by a Land Use Contract
it is necessary to amend the L.U.C. to install the canopy.

Approval of this application is recommended. The downtown revitalization
scheme includes canopies to provide weather protection.
