THE CORPORATION OF THE CITY OF PORT COQUITLAM

BYLAW 2131

A Bylaw to authorize the execution of an
Agreement with Genstar Corporation In
respect of subdivision servicing and
acquisition of utliity services by the City.

WHEREAS Section 729 of the Municipal Act R. S, BoC. 1979, ce. 290 ampowers an
applicant for subdivision of land In a municlpality to enter an agreement
respecting the Installation of works and services for the subdivision;

AND WHEREAS Section 729. further empowers sharing of all or part of the cost of a
Trunk water, sewage or aralnage main between the municipality and the owner of
the land proposed to be subdivided, or the owners of any other ftand that wil!

benefit from the malin;

AND WHEREAS Sections 632 and 635 empower a municipallty to provide for the
establishment, use, acquisition or construct lon of a water distribution utility;

AND WHEREAS Section 611 empowers .Counc!{} to provide for the establishment,
operation and. extension of sewage and drainage works;

AND WHEREAS Section 531 empowers Councl|l to accept and recelve any preperty
transferred to the municipality and Section 19 confers upon a muntcl pall ty the

power to contract for materials and services;

NOW THEREFORE the Municipal Councli of Tha Corporation of the city of Port
Coquitlam, In open meeting assembled, enacts as follows:

The Counell hereby author | zes the antering by The Corporation of the City of Port
Coquitiam of that certaln agreement with Ganstar Corporation attached as. Schedule

The Mayor and Clerk are authortzed to execute the documents necessary for the
purpose aforesald and to afflx the corporate seai of the city thereto,

This Bylaw may be cited for all purposes as the "Gens tar Servicing and Utility
Agreement Bylaw No. 1, 1985, Now 2131",
