Mayor and Aldermen DATE: December 22nd, 1971 JAN 10 1972

At the regular Council meeting held on December 6th, 1971 the following resolution
was passed with respect to the above-noted subject:

"That the City Clerk be instructed to undertake the procedures required to have the
parcel of land known as "Elks Park" dedicated as a Park",

Upon checking this matter immediately after the Council meeting referred to above
we learned that By-law No. 702 of the City “reserves” the property known as Elks Park for
Park purposes. A photostat of Section. 467 and 468 of the Municipal Act is attached and
by reference to these sections the members of Council .will see the ‘difference between
"dedication" and "reservation",

May’ we have the Council's instructions please as to whether or not it coasiders: the

reservation to be sufficient or whether it wishes our Office to proceed under Section 468
of the Act ‘to have che property dedicated. .

If the Council's decision is in favour of the present reservation might we suggest

‘that the Clerk's office be instructed to prepare an amending By-law as the legal descrip-

tion contained in By-law No. 702 is not entirely accurate according to present Land

Registry Office records.

May we have the Council's instructions please.
