Brown Director of Cominunity Planning RE: Rezoning Application No. 31/87 750 Prairie Avenue RECOMMENDATION: That City Council direct +he Clerk's Office to prepare a by law revising the Official Community Plan Schedule A, Section 4.4.1(1) adding (ft) Fremont Street Schedule B, Map adding the subject Property as an apartment site. That the Clerk's Office be directed to prepare a bylaw rezoning the Remnant, East Portion of Lot "B" jin the South East Quarter of Section 6, Twp. 40, NWLD Plan 5345 from A-1 to RS~2,RM-3, COMMENTS: This application is to complete development of lands excluded from the ALR during 1984. Subdivision of this Property wil not lead to additicona! development as the property is a corner lot. The development concept being proposed is to develop ;cul-de- Sac roads off the neighbouring subdivision and to place a cluster of townhouses at the intersection of Prairie Avenue and Freemont Street, An alternative procedure being proposed for approval of the RM-3 portion of the development is to register a restrictive covenant against the Property. The covenant will be to require City appreval for any building to be constructed. This approach is similar to a Development Permit, but operates through the Land Title Act. The reasons for proposing this approach is the owner does not intend to develop the RM~% portion immediately. Consequently, building plans for the site may change. Rather than delay approval of the RM-~3 portion of rhe site, the feeling is that it anhould proceed as bart of ‘the overall rezoning. This is to ensure that if the site is lett for a townhouse development, it will not be down zoned for Single family residential which has different requirements.
