-3- (hb) All other words and expressions in this Agreenent, unless the context otherwise requires, shall have the meaning aesigned to them by the "City of Port Coquitlam Zoning Bylaw, 1963, No. 918", as anended or, 2£ not defined therein, by the "Muncipal Act" or the “Interpretation Act" of the Province of British Columbia. - 2. The Developer is the registered orver of an estate in fee simple of ALL AND SINGULAR that certain parcel or tract of land and premises situate, lying and being in the City of Port Coquitlam, in the Province of British Columbia, and being more particularly known and described as: i. Lot 41, District Lot 465, Group One, Plan 25135, New Westminster District, Except Part Subdivided by By-law Plan Lots 4-10, inclusive, Block One, District Lot 465, Group One, Plan 2364, New Westminster District. All that Portion of Perth Street of District Lot 465, Group One, New Wostainster District as shown dedicated on Registered Plan 2364 included within the green outline on a ‘By-law Plan Prepared by V.C. Goudal, B.C.L.S., and dated March llth, 1975, a copy of which said Plan was attached to and made part of the "Perth Street Plan 25135 Righway Exchange By~law, 1975, No. 1368" of The Corporation of the City of Port Coquitlam. (Now known as Parcel , (By-law Plan. ), District Lot 465, Group One, New Westminster District, Plan 2364.) (hereinafter called "the land" 3. The Developer has obtained the consent of all persons holding any registered interest in the land as set out in the Consents to the use and development set forth herein, which Consents are attached herero, 4. {a} The land, including the surface of water, and any and all , buildings, structures and improvements erected thereon, there- over or therein shall be used for the undernoted purposes only and for no other purposes whatsoever: : One-Family Residential Boarding Accessory Advertising Accessory Residential ~ Accessory Off-Street Parking Personal Care Family Day Care Out of School Day Care Child Minding | a one a - Land Use ‘Contract: -&- Except as otherwise provided in this Land Use Contract the above-noted uses shall be permitted to the limit and extent provided in Part V of the “etty of Port Coquitlam Zoning By- Jaw, 1969, No. 918" as in force on the date of registration of this Agreement in the New Westminster Land Registry Office as if the said use was occurring on property zoned RS-1 (One- Family Residential) under the said Zoning By-law. A copy of ‘the said Part V is attached hereto as Appendix 1. 5. {a} No building, structure or improvenent shall be sited upon the land except in compliance with the site plan entitled "Site Plan Ricard Holdings Ltd." bearing date March, 1975 and prepared by E.H. Management Led., and numbered PC 03 and attached hereto as Appendix 2. (b) All construction details shall conform to the provisions of the applicable portions of the National Building Code of Canada, the British Columbia Plumbing Code, and the "City of Port Coquitlam Building and Plunbing Code Administration By-law, 1974, No. 1298". 6. Notwithstanding the provisions of the "City of Port Coquitlan Subdivision of Land By-law, 1970, No. 992" the land shall be subdivided in the manner shown on the Proposed Plan of Subdivision attached hereto as Appendix 3 and marked "This is the proposed Plan of Subdivision referred to in Section 6 of Land Use Contract No. 11.” 7. No sign or signs shall be erected upon the land or on any building or structure thereon except as permitted by the “City of Port Coquitlam Zoning By-law, 1969, No. 918", as amended, and in accordance with the provisions of the "City of Port Coquitlam Sign By-law, 1969, No. 936" 2s amended, and all proviafons therein relating to signs shall apply to signs herein. 8. Off-street parking and loading spaces shall be provided, located, and constructed in accordance with the "City of Port Coquitlam Zoning By-law, 1969, No. 918", as amended, and any sections of the said By-law relevant to the RS~1 (One~Family Residential) zone shall apply to this Land Use Contract. 9. All buildings and structures to be constructed on the land herein shall conform in all respects te the requirements of the RS-1 (One-Family Residential) Zone pursuant to the “City of Port Coquitlam Zoning By-law, 1969, No. 918", as amended, except for such deviations therefrom authorized and pernitted by this 10.
