"3, The land, including the: surface of water, and any and all bufilings, structures and improvements erected thereon, thereover or therein shall be used only (a) with respect to the Lot 166 referred to in Section 4 hereof and shown on the site plan attached hereto as Appendix IV for those uses permitted in RS-1 (One-Family Residential) Zones in the City and for no other purposes whatsoever. (bo) with respect to the Lot 167 referred to in Section 4 hereof and shown on the site plan attached hereto as Appendix IV for those uses permitted in RM~1 Low-Density Apartment Residential) Zones in the City and for no other purposes whatsoever.” In his report, the City Clerk also recommended that since the storm sewer construction is covered by Section 14 of the Land Use Contract, the word "storm" be deleted from the second line of Section 12 of the Contract, as this is an unnecessary duplication. Mr. Ed Anderson, representing the developer, then submitted a site plan of the proposed development, and Alderman Ranger briefly outlined the location and type of housing that would be constructed, mentioning that approval had already been received from the Department of Highways for this use adjacent to the Lougheed Highway. S Mrs. Pauline Rusk, 3163 Jervis Street, drew attention to the fact that in closing Gordon Avenue and constructing 4 cul-de-sac, there would be no access to the Lougheed Highway, and Alderman Laking also expressed concern that at least walking access for school children through to Hastings Street should be provided. Alderman Ranger stated that this point had been discussed; however, no hardship could be seen for pedestrians in getting down to cross the’ Highway at the traf- fic light. Mr. Anderson referred to Section 13 of the Land Use Contract, and stated he was surprised to see that the developer is required to contribute the sum of $2,400.00 for improvements to the City's waterworks system; also, with respect to Section 14(3), the sum of $5,800.00 for miscellaneous matters, as these were not included in the tentative contract approved by his firm. His Worship the Mayor declared the Public Hearing completed, and the regular Council meeting then convened.
