MEMORANDUM

Re: Strata Subdivision SS#2-79 ~ 2980/90 Flint Street

The above noted property is located at thu South East
corner of Prairie Avenue and Flint Street and Council will recall that at
its last meeting approval wag given for the strata subdivision of the
property. <A complication has now arisen by reason of the fact that the
awning or canopy of the building encroaches on Flint Street and Coquitlam
Avenue by approximately four feet.

In order to comply with the terms of the Strata Titles
Act the Council's approval to this encroachment is required and if Council is
inclined to grant such approval might we suggest consideration bg given to
passage of the following resolution:

"That the approximate four foot aerial encroachment of
the awning or canopy of the building now located on Lots 7 & 8, Block 14,
District Lot 464, Group 1, Plan 2244, New Westminster District, be and the
same is hereby approved;

SUBJECT to registration in the Land Titles Office of a
suitable form of Agreement to save the City harmless from any claims, loss,
damage or expense of whatsoever kind arising from the construction,
maintenance, or existence of the encroachment:

AND THAT His Worship the Mayor and the City Clerk be
authorized to sign the said Indemnity Agreement and all other documents
required for the purpose aforesaid on behalf of the City and to affix the
Corporate Seal thereto,"
