called the *right-of-way") and from time to tine to make all necessary

repairs and alterations to the said trunk sewer line and to renew,

teplace and remove the same and for such purposes to make excavations
and construct works therein and thereon.
(a)
TO HAVE AND TO HOLD unto the Grantee, its successors and

assigns forever.

THE GRANTOR HEREBY COVENANTS and agrees with the Grantee
THAT the Grantor will not erect, place or maintain any buiiding,
Structure, concrete driveway or concrete patio, or any other

improvement or thing whatsoever on any portion of the right-of-way.

AND THAT the Grantor will not do or knowingly permit to be
Gone any act or thing which will interfere with or cause damage to the

said trunk sewer Line.

AND THAT any and all chattels and fixtures installed by the
Grantee on the said right-of-way shall be and shall remain chattels,

any rule at law to the contrary notwithstanding and shall belong solely

and exclusively to the Grantee.

AND THAT the Grantor shall allow the Grantee, its agents and
servants, to enter upon the lands to construct, alter, repair, maintain

and inspect the said trunk sewer line and shall not interfere in any

way nor prevent any such person coming oa the lands for such purposes;

THE GRANTEE HERESY COVENANTS and agrees with the Grantor

that the Grantee:

will not bury debris or rubbish of any kind in excavations
or backfill, and will rezove shoring and like temporary
atructures as backfilling proceeds;

will thoroughly clean the site, raking up all rubbish and
construction debris and leave the site in a neat and clean
condition;

will, repair any damage to the lends or facilities including
landscaping caused by the aforesaid use so as to restore the
lands as far as reasonatly possible to their original
condition;

will, as secn as weather and soil conditions permit, and
insofar as it is practicable te do so, bury, maintain,
repair and/or replace and remove all underground works so as
not to interfere unduly with the surface crainage of the
lands;

will, as far as reasonably necessary, carry out the
construction, alteration, repair and maintenance of the said
trunk sewer line in a proper and workuanlike manner so as to

do as little injury as possible:
