CORPORATION OF THE CITY OF PORT COQUITLAM

BY-LAW NO. 1871

A By-law for the purpose of enforcing the By-laws of. the City of
Forr Coquitlam.

WHEREAS Section 294 of the Municipal Act, R.S.B.C. 1979, c. 290,
provides that the Council of the Municipality may make By-laws for the purposes
of enforcing the By-laws of the Municipality by fine, imprisonment or both, and
for inflicting fines, penalties and costs;

AND WHEREAS the Of Fance Act, R.S.B.C. 1979, -c. 305 provides that unless
cetherwise specifically prcevided in an enactment, a persen who is convicted of an
offence is"liable to a fine of not more than $2000.00 er to imprisenment for not
more than six months, or to both; °

AND WHEREAS is deemed expedient to Provide a standard penalty clause
with respect to most of the By~laws of the City that require such <2 clause;

NOW THEREFORE the Municipal Council of the Corporstion of The City of
Port Coquitlam, in open meeting assenbled, enacts as follows:

i. The Ey-laws listed sn Column 1 of Schedule I of the By-law are amended
by repealing the Section or Sections shown opposite them in Column 2 and substituting
the following:

"Every person who viclates any of the provisions of this By-law.or wie
permits any act or thing to be done in contraventicn or in violation of any of che
provisions of this By-law, or who neglects to do or refrains fron doting anything
required to be done by any of tha provisions of this By-law, or who does any ace
which violates any of the provisions of this By-Law snholt be gudalty of an offenca
punishable on summury cenviction and sitall be iiable to a fine of not more than
$2000.00 or to imprisonment for not more than six months, or to both, the pena®ties
being enforced and the fines and costs being recoverable upon sumaary caiviecion in
the manner provided by the Offence Act R.S.B.C,. 1979, c. 305 as amended".

3. This By-law may be cited for all purposes as the “Enfovcement and Penalty

Section Amendment By-law, 1931, No. 1271".
