Carried. From the City Clerk, October 27th, 1988 regarding Latecomer Charge Waiver Agreement - Lot 1, Plan 15485 Brand Street. Moved by Alderman Keryluk: Seconded by Alderman Laking: At the request of and pursuant to the Agreement with Westside Homes Ltd. dated the 21st of October, 1988, BE IT RESOLVED that the works and services described in the aforesaid Agreement and installed or to be installed by the said Westside Homes Ltd. in connection with the development of the lands described as: Lot 1, Block 4, District Loi: 232, Group 1, New Westminster District, Plan 15486. are hereby conclusively deemed to be for the sole benefit of those lands and that none of the cost of providing the said works and services shall constitute "excess or extended services" as defined by Section 990 of the Municipal Act. AND THAT the aforesaid Agreement be and the same is hereby approved and that the Mayor and City Clerk are authorized to sign the same on behalf of the City and to affix the Corporate seal thereto. Moved by Alderman Keryluk: Seconded by Alderman Laking: Be it resolved that the limitation period prescribed by Section 754 of the Municipal Act, if applicable, be extended to May 18, 1989 in respect of injuries sustained by Jerdan Cripps at Hyde Creek Pool. on May 18, 1988, provided that nothing in this extension shall prejudice the City in the defense of any action which may be commenced.
