the Developer shail save and hold harmless the Clty for any and
all Ifabitlty which may arise out of the construction operations
to be performed on the sald lands; and

the Developer shal | assign to the Clty all rights, title and
interest In any factiitiles and amenities constructed or to be
constructed on the sald lands.

The Developer covenants and agrees to not connect Western Drive to

the read network within the subdivided lands unt | such time as the

connection is required by the City provided that the connection wil
not be required by the City prior to construction of tne cont! quous

pnase of subdivision,

The Developer covenants and agrees to:

@e ragquira that al} purchasers of lots obtain approval from the
Deveioper for erection of dwellings and commercial estab! tshmants

before applying to the City for a Buliding Permit; and

make provision for a representative of the CIty to participate In

the raview of bulliding proposals submitted by purchasers of

commercially zoned properties and properties zoned for multiple

family housing. |
if a delay in complet ton af any covenants herein contained Is caused
bY reason of labour disputes, fire, Act of God , unusual delay by
common carriers or any other act which In the reasonable opinion of
the Counc! | Is effectively beyond the Developer's control, the
Coune! | may-extend the time for completion by the Developer of the
covenants herein contained for whatever time the Counct| deems to be
reasonable In the circumstances

It Is understood and agreed that the Clty has made no

representations, covenants, warranties, guarantees, promises or

agreements (verbal or otherwise) with the Developer other than those
