And tnat City Council at a subsequent meeting adopt a resolution issuing a voluntary development variance permit to: Relax the requirements of the Zoning Bylaw No. 2240, Section 809, RM-5 Downtown Apartment Zone, Subsection ion (6) Rear Yard requirements to permit a corner of the buiiding to encroach into the required rear yard setback, reducing the setback to 2.4 metres. And exempt the project from the requirements of the Development Management Bylaw No. 2242, Division 3 Works and Services, Section 13, Clause (a) imposing Subdivision Bylaw requirements for Building Permits. COMMENTS: In reviewing drawings submitted for a building permit for this project, the above mentioned items were noted. The building design {fs to have the building take an "L" shape. This design has placed a corner of the building in the requirec rear yard. As the design feature is an asset to provide weather protection to the outside living area and reduce building mass, its approval is recommended.
