THIS AGREEMENT made the day of BETWEEN: BANANAS CALIFORNIA RESTAURANT 2573 Shaughnessy Street Port Coquitlam, B.C. V3C 3G3 (the "Owner") THE CORPORATICN OF THE CITY OF PORT COQUITLAM 2580 Shaughnessy Street Port Coquitlam, British Columbia V3C 2A8 (the "City") WHEREAS the Owner leases a portion of that certain parcel or tract of land and premises, situate, lying and being in the City of Port Coquitlam, Province of British Columbia, and more particularly known and described as: 2573 Shaughnessy Street Port Coquitlam, B.C. V3C 3G3 (the "said lands"); AND WHEREAS the said lands are not of sufficient area to permit the Owner to provide the off-street parking facilities required by the "City of Port Coquitlam Development Management Bylaw, 1987, No. 2242"; AND WHEREAS the City holds and has improved a parcel of real property (hereinafter referred to as the "Parking Facility"), for the purpose of providing off-street parking facilities for the use of the public and the said Parking Facility is situate within 95 metres from the said lands, as required by the "City of Port Coquitlam Development Management Bylaw, 1987, 2242" for alternate parking; ITEM | PAGE 97
