Part of this land is owned by the City. LEGAL DESCRIPTION: Lot L, SW 1/4, 7/40, Plan 5114 and Lots 1 and 16 - 29, SW 1/4, 7/40, Plan 2797. BACKGROUND: Council will recall that in the May 28th, 1979 Council Meeting, Council approved the sale of some City land on the east side of 3800 Biock Ulster Street to “Mr. Apel for the development of a 21-lot subdivision of RS-1 zoning. (See attached sketch). The exact land area needed from the City is a 110-foot wide block between Chelsea and Essex (110 feet x 604 feet). This block of land will include part of Ulster road allowance. Initially, we were working on the basis of 50-foot road width for Ulster whereby 16 feet on the east side of Ulster road allowance could be cancelled and sold to Mr. Apel. However, the Engineering Department advised recently that the preferred width is 18 meters (58 feet +). On this basis, we can only cancel approximately 8 feet which will be incorporated into the block of land to be sold to Mr. Apel. The proposed subdivision generally conforms to the long term development plan for the area. As all properties involved are presently zoned RS-2, rezoning to RS-1 is necessary. RECOMMENDATION: The Planning and Zoning Committee recommends that this rezoning application be advanced to Public Hearing. 2 a ’ L. Lee, LL/vw City Planner. Attached. .
