Recognizing Kevin McAught- tie’s efforts to overcome alcohol- ism, Judge Ralph Hudson imposed a $1,000 fine, instead of the more usual jail sentence for a repeat offence. McAughtrie’s last convic- tion for impaired driving was in 1984. Hudson also suspended McAughtrie’s licence for 18 months. Crown counsel Edward Orm- heim said police spotted both men on the roof when responding to the alarms. James ran but was appre- hended by police behind a nearby ouilding, Ormheim said. Blake said neither man was trying to enter the store. Only after James was arrested did he realize his actions could be interpreted as a break-in attempt, Blake said. Onnheim said over $1,000 dam- age was done to the store however all but $360.60 was covered by insurance. . Judge Ralph Hudson said a lack of regard for other people’s prop- erty can result in this kind of situation. He placed James on probation for six months and ordered him to pay $360 restitution. McAughtrie may be given a breathalyzer test at any time by police and any reading will be a breach of probation, Hudson said. Crown counsel Edward Orm- heim said McAughtrie was stopped by Pender Island RCMP on the island Nov. 24 after police noticed his erratic driving. He had two breathalyzer readings of .19 per cent. McAughtrie pleaded guilty to impaired driving. Defence lawyer John Green said McAughtrie has completed a resi- dential treatment program for alcoholism and is a recovering alcoholic. Although trained as a ski man- ager, he left the business after eight years because the party atmos- phere at ski resorts offered too much temptation. McAughtrie is now a store manager, Green said. Alcohol is a problem for his client’s entire family, Green explained.
