Continued from Page A6é Victim’s father wants Tanner fo explain Editor: In writing this letter 1 am attempting to offer a controlled and measured response to a situa- tion that has made me very angry. The situation I refer to has to do with one Theologus Joseph Gar- dener, owner of Pelicano’s Cafe and Bakery in Sidney and a man who, on October 22, was con- victed of two charges relating to two separate but closely coinci- dent acts of sexual assault involv- ing two victims (Businessman guilty, The Review, Oct. 28). Mr. Gardener, by the way, has prior convictions, including a three-year jail term, dating back as far as 1971. Mr. Gardener was, on the morning of November 26, sentenced by Justice Kenneth C. Murphy to four years impmson- ment for his crimes. The reason for my very intense reaction is that Mr. Gardener’s recent offenses struck very close to home. A bull’s-eye, in fact. Mr. Gardener raped my daugh- ter. He was 50 or 51 years old at the time. My daughter was 14. Because of her age, my name is withheld from this letter. Having heard first-hand Mr. Gardener’s own testimony during the proceedings, it was evident that there were no extenuating circum- stances. The events did not occur in the face of provocation, nor in the context of an hormonal eruption that momentarily overpowered his faculties of reason and morality. Mr. Gardener’s actions were, by his own testimony, entirely pre- meditated and wholly predatory in nature. Despite the anger of a parent whose child has fallen prey to a sexual offender, I do feel that justice has been served. The conviction and sentence are a comfort to me and presumably to other parents and children who are spared the possibility of similarly harmful encounters with Mr. Gar- dener in the near future. I believe that a very lengthy parole following incarceration is also_warranted. Experts suggest that the prospects of rehabilitation “in these situations are slim. I am grateful for the insightful and reasoned deliberations of The Honorable Mr. Justice Murphy and his unwillingness to be swayed by specious arguments and unenlight- ened testimonials. He had much to consider and it was a difficult case. On this point of “unenlightened testimonials,” I have one final comment to make, and offer as the most astounding example of this, the written testimonial offered by Clive Tanner, MLA and caucus member of the Liberal Opposition. Mr. Tanner has seen fit to use his official position as a member of the Legislative Assembly of the Province of British Columbia, to attest to the “good”’ character of a convicted sex offender with, as indicated at the beginning of my letter, a string of convictions dat- ing back to 1971. It is of interest, and all the more astonishing, that essentially the entire substance of Mr. Tanner’s support of a convicted sex ofifen- der is that Mr. Gardener operated a successful business and provided employment in Sidney. It is precisely Mr. Gardener’s exploitation of his status as a businessman that underlies his offenses. Were he not a business- man, my daughter would not have become his victim. It is long overdue that we recog- nize that predatory men like Mr. Gardener project an outward image of respectability. It’s not the “dirty old man in the rain coat” that we have to be afraid of. It is those who deliberately and meticulously cultivate an image of respectability and community ser- vice and beneath this cloak of respectability conceal their perver- sions. We have a right to expect more from our MLAs and I believe that public sentiment is rather strongly in favor of greater protection from criminals, particularly where chil- dren and sexual offenses are con- cemed. We do not need the likes of Mr Tanner using his good offices to lend misguided and inappropriate support to the cause of a sexual predator with multiple convic- tions. I would recommend to Mr. Tan- ner that he “get with the program” and in the process, perhaps he would care to explain his actions.
