Sidney council is encouraging the Artificial Reef Society to investigate future possibilities of sinking an abandoned vessel off Sidney’s' coastal waters. Although current zoning on Melville allows for a two-family duplex, residents living behind the property on Ardwell Avenue are zoned single-family and submitted letters of opposition to the devel- opment. Josephine Higgins, a resident of Ardwell since 1971, says she was always under the impression the area was zoned for single-family dwellings. “I do not like to think of Melville as a street of duplexes. I feel it should be rezoned to single dwelling homes,” Higgins wrote. John Calder who voted’ against the variance application, said that people seem to be tired of continuing developments, espe- cially when they don’t fall under the affordable housing concept. Mayor Marie Rosko said she had toured the area and didn’t feel a duplex would be out of character. “It seems it’s the residents on Ardwell who are opposed to this development. The area is already zoned for duplex construction and the developer’s plan suits the property very well,” Rosko said. Gardener, now serving a four- year jail sentence on the earlier conviction, appeared in Sidney provincial court Dec. 10. He is charged with sexual assault of a 35-year-old Victoria woman. Gardener pleaded not guilty and preliminary hearing is set for June 18 in Sidney’s provincial court house. Crown counsel Anne Wallace received a ban on publication protecting the identity of the com- plainant.
