Brown Director of Planning RE: Ricard - Hughes Subdivision RECOMMENDATION: That City Council adopt the attached Development Permit resolution, varying the front yard setback requirements for the proposed lot 63 of the Ricard ~ Hughes Subdivision containing the existing Hughes residence. COMMENTS : Necessity for this Development Permit was discovered this afternoon, Monday 17 March at 5:00 P.M. The reason for this Development Permit is that in the proposed subdivision being considered by the Subdivision Approving Officer, is that Mr. Hughes residence does not meet the minimum setback requirements from a road. A copy of a Survey Plan showing the location of the existing house on the proposed lot. is' attached. Mr. Hughes problem is that his house is set’ back 7.27 metres from the proposed road and a 7.5 metre setback is required. Also, there is a carport in the required frontyard, this is not permitted by the Zoning Bylaw. The house complies with al1 other Zoning Bylaw requirements. . This problem is a minor one that can be remedied after the zoning is in place. Due to its impact, holding up both the Hughes and Ricard subdivisions this Development Permit is being put forward as an avenue to permit the projects to, proceed.
