SUBJECT: FENCE ON CITY PROPERTY - 1238 EASTERN

That an agreement (highway encroachment) be written to address the responsibility
for maintenance, liability, etc.;

if the City requixes entry onto the property that the owner be responsible for the
removal and replacement of the fence;

that the owner be responsible for the maintenance of the area between the sidewalk
and the fence; and

that the solicitor be instructed to prepare the correct documents.

A request was made by the owners of the multi-family complex at 1238 Eastern to allow the
construction of a wood fence on 4 road right-of-way. The roposed fence will be placed along
the existing sidewalk on the west side of Easter. Currently the ground slopes down from the
sidewalk, the owner wishes to keep the fence above sidewalk grade to allow for more privacy to

the individual units.
