Subject to registration of restrictive covenants on each of the two parcels to be created, stating that no building permit applications will be made until both the on site services and off site services are completed. Subject to deposit of a refundable letter of credit in the form attached and for the amount shown on the attached Tentative Approval Checklist, said letter of credit being a security deposit to ensure construction of the works listed on the checklist. “The amount of this letter of credit to be increased annually, due to inflation, at an agreeable rate and method. If the City requires that the services be installed prior to the completion of the 5 year term, the developer agrees to install the services within one year at notice by the City to complete the services.
