Big Boys Toys. and its owner have been found guilty in Sidney Provincial Court of deceptive trade practices in sell- ing a tent-trailer. on. consign- ment last fall. By JULIETTE PROOM ~ Review Staff Writer The Henry Avenue recreation vehicle dealership and principal ‘Tony Cerniauskas will be sentenced in Sidney Provincial Court Thursday. In a 10-minute oral decision, Judge Stephen Denroche said, “Itowas clear Mr. Cerniauskas misled and deceived (the trailer owners) throughout the transac- tion.”’ Stan Pollak testified ~ he believed Big Boys Toys would sell his Bonair trailer on 10 or 15 per cent commission. He. was upset When Cerniauskas refused _to show him a bill of sale. Initially, Pollak believed. Big Boys Toys. would sell his tent trailer for $3,000 or $3,200. He dropped off the trailer in mid- September without agreeing to a firm selling price. Pollak agreed to an. undefin- ed commission. He said he understood he would have to pay for repairs and a new pro- pane bottle. On Sept. 21 or 22, he called Big Boys Toys, asking if a price had been set on. the trailer. “Tony said he put it on the market for around $3,300.. It seemed to be in good shape,” Pollak said. In the next few weeks, P ollak agreed to go down in price to $2,500. ‘‘I was content with that ~ figure as long as he was still tak~ ing 10 or 15 per cent,’” he said. Pollak and his wife: stopped by the RV lot on Oct. 10, the’ day the trailer sold. ‘‘I leaned. -over in the car and asked what the selling price. was,’’ testified ‘Patricia. However, he asked for free wiring to connect the trailer with his Volkswagen van and a pair 4 boat racks. On Oct. 17, the Pollaks were given a nea for $2,400 for their trailer, court heard. Cerniauskas said he agreed to pay the Pollaks $2,700 less costs from the start. ‘tl had the con- signment agreement on my desk ready for him to sign when he gave me the registration and keys. For some reason we didn’t sign anything.’* The consignment agreement said Big Boys Toys would give the Pollaks $2,700 less the $100 cost of an inspection of the pro- . “pane system and whatever other costs were directly attributed to the trailer. This includes things like repairs to the canvas, lights and a paint job. “We like to vive each unita brand new look for each new customer,”” said’ Cerniauskas. The Pollaks were charged about $200 for the inspection, a new propane battle and repairs, he said, Cerniauskas said.in 15 years of selling recreational vehicles, he has always given a firm price on consignment sales. ‘We have to know what our costs are. The retail price had ab- solutely no bearing on my deal- _ings with the Pollaks.”” He had no answer when the judge asked him why he did not provide the Pollaks with a copy of the consignment agreement when they requested a copy of the bill of: sale. *‘Mrs.° Pollak seemed. quite perturbed that | wouldn’t jump into my office ‘and give. her all. my documents.’ , ‘The judge said that he was familiar | with intrusion. of. government. in private business practices, it has : occurred to me. that such. con-. ‘tracts. ‘are ‘subject to “flagrant. “abuse and ought tobe subject to Some scrutiny,” Vhe said. iene ced ral grt om rapa anurpetleyy* vy i ~ a . j & pn CO v9) pane pest ag consignment =: -agreements. “While I resent the » May 18th to 2ath ‘ amet Pe rennereDrt nes metnngy | i anygiinen’ addin tit fheteetpoeayainierant Foanpratine tad Baiab alive, Haak SK MG Page AY Hospital dog missed | Big Boys Toys guilty of deceptive trade Denroche found Cerniauskas and Big Boys Toys Ltd. per- formed ‘ta deceptive act within the meaning of the legislation.” He found both accused guilty as charged.
