Pan accident scene —- but she
nonetheless understood the Char-

' judge ruled Thursday,

Dawn Hughes, 30, was fined
$350 and prohibited from driving
for a year, on a conviction of
having care and control of a car
while her blood contained more
than .O8 per cent alcohol.

Judge Kennedy McAdam also
tuled that Hughes’s right to con-
tact a lawyer was not denied before
* abreath test at the hospital, despite
gontrary testimony from her
‘mother.

Court heard that Hughes was
found behind the wheel of a car on
7th Street in Sidney, after 12
midnight June 6. The car had hita
parked tow truck from the wrong
side of the sueect and been badly
damaged.

“=found Hughes trying to start the
-car despite severe front-cnd. dam-
ae that wouldn’t allow the engine

'. The policeman testified that

- He said her speech was slurred

Hughes told the policeman,
‘Bob was: driving,” and that “I

Defence lawyer Nick Lot
argued that because Hughes was
injured in a severe accident, a
“confused und. disoricnted”” con-
dition resulted.

Lot added that Huyhes’s
actions and words showed that
“my client probably didn’t under-
stand what was being said to her.”

He also said the policeman

should have sought an order for a
blood sample, because of the
woman’s condition.

“It doesn’t mean the police and
the investigation are left without
their remedics.”

Lott also said his client’s- rights
were denied at the hospital: The
mother’s. testimony could -be
trusted because the situation was
unique and would stay in her
memory, he said.

But Crown counsel Derck Lister
characterized the mother as too

her concern for her daughter,” *
Lister said.

Lister said the daughter's
acuons and words at the scene
showed she understood her predi-
cament,

Placing the keys between cush-
ions “may not have been a sophis-
licated aliempt” at escaping con-
sequences, but it was sul an
atiempt, Lister said.

“Attempts were made to get rid
of the keys and to direct attention
away from herself, 10 some mythi-
cal person named Bob,”’ Lister
said,

Judge McAdam said Hughes’s
actions at the accident scene
related to what was happening.

At the hospital, “1 don’t think
there was any demand for a lawyer

at that time and 1 don’t think (the

police) would have ignored it if
there was,” he said.
